TERMS OF SERVICE for Chromatic

1. BINDING AGREEMENT By accessing the Chromatic storefront and purchasing our products, you agree to be bound by these Terms of Service. If you do not agree to all terms, you are prohibited from using the site or purchasing goods.

2. NATURE OF GOODS (PRINT-ON-DEMAND) You acknowledge that Chromatic is a print-on-demand service. Products are not pulled from a pre-existing inventory but are manufactured uniquely for you upon order completion.

  • Variations: Because items are handmade/printed by third-party manufacturers, you accept that slight variations in pattern alignment, color saturation, and stitching are inherent to the process and do not constitute a defect.

  • Final Sale: All orders are final. No returns or exchanges are accepted for "buyer’s remorse," sizing errors, or color preference.

3. LIMITATION OF LIABILITY (THE "NEARLY ZERO" CLAUSE) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHROMATIC, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

UNDER NO CIRCUMSTANCES WILL CHROMATIC BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHROMATIC ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR PRODUCTS; (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE.

4. THIRD-PARTY MANUFACTURING & SHIPPING Chromatic utilizes third-party manufacturers and shipping carriers. You agree that Chromatic is not liable for:

  • Delays caused by shipping carriers or customs.

  • Packages lost or stolen after a "Delivered" status is confirmed by the carrier.

  • Manufacturing delays or supply chain interruptions.

5. INTELLECTUAL PROPERTY All vibrant patterns, textile designs, and digital assets found on Chromatic are the exclusive intellectual property of Chromatic. Purchase of a physical garment does not grant a license to replicate, scan, or digitally redistribute the patterns.

6. INDEMNIFICATION You agree to defend, indemnify, and hold harmless Chromatic and its agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of the products or your violation of these Terms.

7. GOVERNING LAW & ARBITRATION These Terms shall be governed by the laws of [Your State]. Any dispute arising from these Terms or the use of Chromatic products shall be resolved through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

8. "AS IS" WARRANTY ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CHROMATIC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.
